OFFICIAL RULES FOR THE “FLY AWAY WITH AN iPAD”
CONTEST.
1. CONTEST DESCRIPTION.
These official rules (“Official Rules”) apply to the “Fly Away with an iPad”
contest offered by Marketplace at Birdcage. To enter the contest online, you
agree to submit your name and email address via the online entry form at
shopbirdcage.com for a chance to win, or to enter the contest in person, submit
an entry form at Off Broadway Shoes at Marketplace at Birdcage for a chance to
win. Either form of entry is subject to the following terms and conditions.
Marketplace at Birdcage is the official sponsor of the contest. Apple Inc. is
not a sponsor of this contest and does not endorse or otherwise have anything to
do with this contest.
2. NO PURCHASE NECESSARY.
Void where prohibited. Subject to all federal, state and local laws.
3. ELIGIBILITY AND ENTRY REQUIREMENTS.
By entering the “Fly Away with an iPad” contest, you are confirming that you are
thirteen (13) years of age or older and that you live in the 50 United States or
the District of Columbia. Employees of businesses located at Marketplace at
Birdcage shopping center, Jones Lang LaSalle, their advertising and promotion
agencies, web site providers or other parties involved in any aspect of the
creation, operation or fulfillment of the contest and immediate family members
of such employees, are not eligible to enter. The contest is subject to all
applicable laws and is void where prohibited. You agree to abide by and be bound
these rules. All decisions of Sponsor and/or its designee are final and binding
in all respects. Limit one entry per person.
4. CONTEST PERIOD AND RELEASE OF LIABILITY.
Entries must be submitted or received between 1 PM (Pacific Time) on July 2,
2010 and 11:50 PM (Pacific Time) on September 17, 2010. The contest sponsor,
Marketplace at Birdcage, assumes no responsibility for lost, misdirected or late
entries or entries containing incomplete or incorrect information. All entries
submitted become the sole property of the Sponsor and will not be acknowledged
or returned.
5. ENTRY.
You may enter the contest online or in store at Off Broadway Shoes. Submitting
an entry constitutes agreeing to the terms of these Official Rules. Online entry
requires first and last name and email address (phone number is optional). Go to
shopbirdcage.com and click on the contest link to reach the entry page. Fill out
the entry form and submit.
In order to be entered without submitting the
online entry form, an Entrant may complete an entry form and deposit it at Off
Broadway Shoes (Marketplace at Birdcage location only). Limit one entry per
person.
6. PRIZE.
Prize:
One (1) 32GB Apple iPad™ Wi-Fi. Estimated retail value: $599.
Odds of winning are determined by the number of
eligible entries received. Only one prize shall be awarded and no substitutions,
cash equivalents and/or redemptions shall be made, except that Sponsor reserves
the right to substitute any Prize with another prize of equal or greater value,
including a cash award, in the event that the applicable Prize is not available.
Reporting and payment of all applicable taxes, fees, and/or surcharges, if any,
arising out of the acceptance of any Prize are the sole responsibility of the
Prize Winner. Designation as a Prize Winner is non-transferable. Prize winner
will be notified by email or phone (if available) on or about September 30,
2010.
7. CONDUCT.
By entering this contest, each entrant (and/or their parent or legal guardian,
if under 18), agrees to be bound by these official rules and by the decisions of
the Sponsor and its judges and agents. Sponsor reserves the right at its sole
discretion to disqualify and prohibit any entrant from participating in the
contest or winning a prize whom Sponsor suspects of attempting to undermine the
legitimate operation of the contest by cheating, hacking, deception or other
unfair playing practices (including the use of automatic quick entry programs).
8. PUBLICITY CONSENT.
Entrants authorize the Sponsor or its agents to use their name, voice, likeness,
biographical data, city and state of residence and entry materials in
promotional material, in any and all media now known or hereafter created or
conceived, worldwide in perpetuity, or on a winner's list, if applicable,
without further compensation unless prohibited by law. Sponsor is not obligated
to use any of the above-mentioned information or materials, but may do so and
may edit such information or materials, at Sponsor's sole discretion, without
further obligation or compensation.
Winner is picked on or about September 30, 2010
and will be notified by email (or phone, if available). Thank you for your
